CLIENT'S GUIDE

THE PURCHASING PROCESS

The purchasing process takes place in three simple steps, depending on the type of contract to be signed:

  • Reservation Contract – you choose and reserve the apartment that best suits your needs by paying a small advance through which the home will be reserved until the sale-purchase pre-contract is signed within the term stipulated in the reservation contract, which will be subsequently deducted from the total price of the apartment.
  • Pre Purchase and Sale Contract (in the presence of the notary approved by the real estate developer) – implies an additional advance from the apartment’s price, which will also be deducted from the total cost when signing the purchase and sale contract.
  • The Purchase and Sale Contract, based on which you will receive the deed of ownership of the home, will be perfected (in the presence of the notary) after the final reception at the completion of the construction works. When signing the purchase and sale contract, the house will be paid in full by personal means/ sources or by accessing a bank loan.

THE REQUIRED DOCUMENTS

To purchase an apartment as a private person:

  • For the reservation contract, a copy of the identity card is sufficient. We will provide you with the plan of the apartment in which the useful and approximate built surface is described and also, the plan of the parking place, if applicable.
  • In order to sign the purchase and sale contract, you must give the notary a copy of the marriage certificate (if applicable), together with the identity document.
  • When signing the purchase and sale contract, you will be provided with a copy of the Land Book Extract for authentication, the Energy Performance Certificate in original, the cadastre of the building and the parking place.

In addition, the notary may ask you for other documents deemed necessary to complete the purchase procedure.

To purchase an apartment as a legal entity:

  • For the purchase and sale contract, we will need the Registration Certificate and the Constitutive Act of the company and the identity document of the representative.
  • Decision of the General Meeting of Shareholders or notarial power for the representative.

DEVELOPMENT PROCESS AND SITUATION OF PERMITS AND AUTHORIZATIONS

The completion of the works will be certified by the reception of the buildings. After the reception phase, the respective buildings will be registered with the Cadastre Office. The preparation of the documents necessary for the conclusion of the sales contracts will follow.

WARRANTIES OFFERED FOR PURCHASED PROPERTIES

The guarantees offered in accordance with the requirements of the law are the following:

  • Guarantee for hidden defects of the building – 3 years – this guarantee refers to possible defects of the unit that appear during the period after the signing of the delivery process of the apartment until the expiration of the guarantee period and which the developer will remedy from at his own cost. This guarantee is offered according to Law 10/1995 regarding the quality in constructions with the modifications made, the building being classified in the category of importance C as found in ART. 7 Alin. 3 of the aforementioned law.
  • The guarantees related to materials, doors, parquet, ceramic wall and floor tiles, electrical appliances, boiler, radiators, sanitary ware, elevator, windows – are provided by the suppliers. During the warranty period they will remedy the various defects arising from their correct use. The duration of the guarantee will be specified and will be found in the contracts related to the construction book and the individual apartments.
  • The designer, the certified project verification specialist, the manufacturers and suppliers of construction materials and products, the executor, the technical manager with the authorized execution, the authorized site manager, the certified technical expert responds according to their obligations for the hidden defects of the construction, arising in an interval of 10 years from the reception of the work, as well as after the completion of this term, for the entire duration of the construction’s existence, for the defects of the resistance structure resulting from the non-observance of the design and execution norms in force at the date of its execution according to Law 10/1995 ART. 30.

WILL THERE BE A CODE OF CONDUCT IN THE PROJECT?

Of course, this will be an annex to the Pre Purchase and Sale Contract. This set of rules aims to establish the general conduct for all residents, so that they can be part of a good neighbourhood and a pleasant and safe environment.

HOW WILL YOU TAKE POSSESION OF THE APARTMENT AFTER SIGNING THE SALE CONTRACT?

By signing the contract, the Buyer takes possession of the apartment. The seller will actually deliver the property on the same day or at a later date, established in the manner agreed by the Parties, on the basis of a delivery-receipt report by which it is ascertained that the apartment is finalized, connected to utilities and not having any particular faults that would delay it’s signing.

WHO WILL MANAGE THE PROJECT AFTER THE FINAL RECEPTION?

The management of the Residential Complex will be provided by a management company (maintenance) recommended by the developer, validated after the owner’s association is established. Just to be sure that we offer a quality product, we want each of our customers to be very satisfied and to enjoy the newly purchased home. Before establishing the owner’s association, the developer will make a contract with the maintenance company, and will re-invoice the administrative services to the new owners once the association is created.

WHAT ARE ADMINISTRATIVE SERVICES AND THEIR COSTS AFTER YOU MOVE IN?

The administrative services are necessary for the operation and maintenance of the complex, namely utilities, garbage collection, cleaning, landscape maintenance, street lighting, elevator maintenance, sanitary and electrical installations, security and access control, snow removal, current repairs and others. The cost of these services will be determined at the time of the conclusion of the contract at a price comparable to the market average for such services.

WHO WILL BE IN CHARGE WITH THE MAINTENANCE OF THE GREEN AREAS AND PLAYGROUNDS?

The company that is in charge with the administration will maintain the common spaces like the landscaping and the playgrounds.

ARE PETS ALLOWED IN THE COMPLEX?

Yes, pets are welcome in the complex.

WILL THERE BE A HOUSEHOLD WASTE COLLECTION SERVICE IN THE COMPLEX?

The sanitation services will be provided within the Drumul Taberei Residence project. All the debris will be stored in containers, which will be positioned so as not to impact the pleasant appearance of the complex.

AM I OBLIGED TO PURCHASE A PARKING SPACE IF I HAVE A CAR?

To park inside the complex, you need a parking space designated by a purchase and sale contract with the developer or a third-party owner. The parking spaces that will be owned by the developer will have blockers, parking on them is strictly forbidden. In case the developer finds that one of his parking spaces is used without his consent, he reserves the right to act according to the law!

HOW CAN I MONITOR THE DEVELOPMENT OF THE PROJECT?

Soon you will be able to monitor the development stage on the website www.drumultaberei-residence.ro where you will have a live video camera surveying the project or you can request more information at the email office@drumultaberei-residence.ro

I HAVE AN INFILTRATION, WHO IS RESPONSIBLE FOR THE REPAIR?

All buildings have a 3-year warranty for hidden defects. This means that if the leak occurs due to a hidden malfunction of the installation, you must inform the administrator or the developer representative and the repair will be done at no additional cost. If the leak occurs as a result of actions / works that you did (or did not do), we offer you our support throughout the process at minimum costs.

CAN I INSTALL BLINDS OUTSIDE THE WINDOWS?

Any changes that may affect the exterior image of the building must be approved by the developer of the complex. You will be able to make a request that can be approved or we can recommend to you a supplier who has already received the agreement to do a similar work.

HOW IS THE WARRANTY AFFECTED IF I MAKE CHANGES INSIDE THE APARTMENT?

This depends on the changes you want to make and if you work with an approved supplier. In general, a change that leads to failure is your responsibility. If, however, through the works performed, you discover any hidden defects, the warranty remains intact.

IF I SELL THE PROPERTY BEFORE THE TERMINATION OF THE WARRANTY, ARE THE RIGHTS TRANSFERED TO THE NEW OWNER?

The warranty is not affected by the fact that you sell your house. It is useful to give all the details about the guarantee and what it covers to the tenants or potential buyers. If you sell your house while it is under warranty, it will be automatically transferred to the new owner.

I AM WORRIED TO MOVE IN BEFORE THE COMPLETION OF ALL THE WORKS IN THE COMPLEX

On a construction site there will always be some dust, debris or noise. While we continue our work, we will make sure that the technical teams will keep the area around your house clean and give you unrestricted access to your new home. Of course, any concerns you have about the inconvenience caused by the construction can be discussed with the Site Manager or the Developer Representative.

HOW WILL THE RECEPTION OF THE APARTMENT BE DONE?

We schedule an inspection visit, in which the entire unit is thoroughly checked in its smallest details and any problem reported is recorded and discussed with the Ideal Residence Developer representative. It is important to check the door keys, the opening and closing of the doors and windows, flushing of the toilets, to run the faucets and to check in detail each room, each power outlet, each light switch – the list is signed as part of the delivery-receipt process and any problem is registered and fixed before handing over the keys.

WHAT SHOULD I DO IF I WANT TO MAKE CHANGES TO THE APARTMENT?

If the changes do not modify the exterior appearance of the building or they do not affect its structural elements and have no impact on the infrastructure, they can be done after signing the purchase and sale contract and the delivery-receipt process, following the procedure. However, it is always best to ask for our advice.

WOULD IT BE POSSIBLE TO ENCLOSE MY BALCONY OR MY TERRACE?

The enclosing of the balcony will be done only with harmonic glass as described in the regulation. You will be able to make a request that can be approved or we can provide you with a supplier who has already received the approval to do a similar job. Any changes that may affect the exterior image of the building may harm other tenants.

Does the Drumul Taberei Residence project comply with the Housing Law 114/1996?

Increasing the quality of people’s lives is our main objective, thus the design of the Drumul Taberei Residence was executed in accordance with the Housing Law 114/1996 and respects the minimum requirements that are found in the 1st Annex, part of this law.
